Terms of Service

This update corrects factual product descriptions. It does not change accepted agreements, existing purchases, billing entitlements or customer rights.

1. Acceptance of Terms

By accessing or using Ultimate Creator AI ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. These terms apply to all users, including creators, developers, agencies, and enterprise customers.

2. Service Description

Ultimate Creator AI provides AI-assisted video tools and API access. Individual features, providers and outputs depend on account eligibility and availability. Review the cost shown for a supported paid workflow and your applicable agreement before authorizing generation.

3. User Accounts

You must create an account to access most features of the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Content & Intellectual Property

You retain ownership of content you create using the Platform. However, you grant Ultimate Creator AI a limited license to process, store, and deliver your content as necessary to provide the services. Signing-enabled outputs can carry C2PA provenance metadata. Its presence and verification depend on the output path and retained original; provenance does not establish consent or legal clearance.

5. Avatar Consent & Digital Twins

All digital twin avatars require verified consent from the person being represented. Technical consent and licensing checks do not replace permission records or legal review. Violation of avatar consent policies will result in immediate account suspension and potential legal action.

6. Billing & Credits

The Platform uses credit-based billing. Credits may be reserved before generation and settled against the result. A reservation is not an automatic quality guarantee or promise of a refund. Existing purchases, plan terms and written agreements continue to govern credit rollover and refund rights. Contact support for billing review.

7. Prohibited Use

You may not use the Platform to create content that is illegal, harmful, threatening, abusive, defamatory, or that infringes on any third party's intellectual property rights. Content moderation guardrails are applied automatically. Repeated violations will result in account termination.

8. AI Model Use Restrictions (OpenRAIL++ Pass-Through)

Portions of the Platform's output are generated by machine-learning models licensed under the CreativeML Open RAIL++-M license. That license requires us to pass its use-based restrictions (Attachment A) through to our users. In addition to Section 7, you may not use the Platform, or any content generated with it (including but not limited to video, image, audio, avatar, and other AI-generated outputs produced by OpenRAIL++-M models), to:

  • violate any applicable national, federal, state, local, or international law or regulation;
  • exploit, harm, or attempt to exploit or harm minors in any way;
  • generate or disseminate verifiably false information with the purpose of harming others;
  • generate or disseminate personally identifiable information that can be used to harm an individual;
  • defame, disparage, or otherwise harass others;
  • make fully automated decisions that adversely affect an individual's legal rights or create or modify a binding, enforceable obligation;
  • discriminate against or harm individuals or groups based on online or offline social behavior or known or predicted personal or personality characteristics;
  • exploit any vulnerabilities of a specific group of persons based on their age or social, physical, or mental characteristics in order to materially distort their behavior in a way that causes or is likely to cause physical or psychological harm;
  • discriminate against individuals or groups based on legally protected characteristics or categories;
  • provide medical advice or interpret medical results;
  • generate or disseminate information for use in the administration of justice, law enforcement, immigration, or asylum processes, such as predicting that an individual will commit fraud or a crime.

Violating these restrictions breaches both these Terms and the upstream model license, and may result in content removal and account termination.
